Environmental Procedural Rights Projects

The Rio Declaration adopted in 1992 brought to the fore the issue of environmental governance and the role of various actors. For sustainable development to be realized it is imperative that laws and policies be in place that provide for substantive rules. It is equally important that there be adequate rules and provisions that deal with the procedural aspects. Principle 10 of the Rio Declaration neatly summarized these procedural aspects as the principles of public participation, access to justice and access to information.  State parties to the Rio Declaration are required to put in place national laws and policies that recognize and promote these procedural rights.
One of the first activities that the Institute undertook was a project that sought to analyze the legal and policy framework for environmental procedural rights in Kenya. The project was undertaken in the year 2002-3 and involved several activities including:
The research revealed that the legal and policy framework for environmental procedural rights though having undergone changes was still not adequate in promoting environmental governance. Proposals for improving it were made in the report. The Community Guide on Environmental Management, one of the products from the project proved to be a useful launching pad for ILEG onto the national scale as a strong policy and advocacy group. The document has also proved to be a useful tool for communities and organizations working with local communities.
